Ombudsman Suspends Catanduanes VP, 11 SP Members

Ombudsman Remulla orders 6-month preventive suspension of Catanduanes Vice Gov Fernandez and 11 SP members over alleged QRF misuse after Typhoon Uwan.

The Office of the Ombudsman has ordered the preventive suspension of Catanduanes Vice Governor Robert Fernandez and 11 members of the Sangguniang Panlalawigan (SP) without pay for six months, citing strong evidence of grave misconduct and grave abuse of authority in connection with the alleged irregular use of the province's Quick Response Fund (QRF) following the devastation brought by Super Typhoon "Uwan" in November 2025.

Ombudsman Jesus Crispin Remulla issued the suspension order on May 22, 2026, with the directive taking effect immediately. The announcement was made public on Friday, May 29, 2026, through an official press release from the Office of the Ombudsman.

The case stems from a complaint filed by Catanduanes Governor Patrick Alain Azanza, who accused the respondents of irregularities in the utilization and allocation of P30.5 million in provincial QRF intended to assist families affected by the November 2025 typhoon.

QRF Allocation Revised by SP Without Governor's Approval

According to the Ombudsman's order, the respondents — acting collectively as the Sangguniang Panlalawigan — revised the utilization and allocation plan originally proposed by the Provincial Disaster Risk Reduction and Management Council (PDRRMC) for the province's QRF.

The SP moved to redirect more than P26 million of the P30.5 million fund toward cash assistance for typhoon victims, departing from the PDRRMC's original proposal which focused on goods and in-kind relief.

Governor Azanza subsequently vetoed the SP ordinance, citing DBM-DILG-NDRRMC Joint Circular 2013-1, which explicitly does not include cash assistance among the allowable immediate response activities under QRF guidelines.

The governor argued that cash assistance falls outside the scope of legally permissible QRF expenditures, and that the SP's actions not only violated established regulations but also caused critical delays in providing aid to disaster-affected residents.

Over 39,000 Families Left Without Timely Assistance

Governor Azanza stressed in his complaint that the respondents' actions directly impeded the provincial government's ability to address the urgent needs of more than 39,000 families affected by Super Typhoon Uwan.

The delay in QRF disbursement, the governor argued, had real and serious humanitarian consequences, leaving thousands of families without timely relief in the weeks and months following the typhoon's onslaught in November 2025.

The Ombudsman's order noted that the suspension was necessary in part because "there is a need to preserve the documents and evidence pertaining to this case which they may have control and custody," and to prevent "further commission of malfeasance and/or misfeasance in office."

Additional Acts Cited: MOA Delay and Budget Obstruction

Beyond the QRF controversy, Governor Azanza's complaint cited several other collective acts attributed to the respondents.

These included the alleged deferment of a request for authority to enter into a Memorandum of Agreement (MOA) with the Department of Human Settlements and Urban Development (DHSUD) for the provision of construction materials for Super Typhoon Uwan victims — a measure that would have provided more immediate structural relief to displaced families.

The SP members were also accused of causing delays in the enactment of budget appropriations for fiscal year 2026, further hampering governance and public service delivery in the province.

Additionally, the respondents allegedly issued a resolution in January 2026 declaring Governor Azanza as Persona Non Grata in Catanduanes — a move that has drawn attention to the deepening political rift between the executive and legislative branches of the provincial government.

A total of 12 elected officials — the vice governor and all 11 named SP members — are covered by the suspension order, which takes immediate effect pending the final resolution of the administrative case against them.

Ombudsman Cites Strong Evidence of Guilt

In issuing the preventive suspension, Ombudsman Remulla's order explicitly stated that "there is strong evidence showing their guilt" for the charges filed against the respondents.

The charges include grave misconduct, grave abuse of authority, and conduct prejudicial to the best interest of the service — all serious administrative offenses under Philippine law that can result in dismissal from government service if proven in the final adjudication.

The order further stated that the suspension was issued because "their continued stay in office may prejudice the investigation of the case filed against them," reflecting the Ombudsman's determination that the respondents' presence in their official capacities posed a risk to the integrity of the ongoing inquiry.

Suspension Terms and Duration Under Ombudsman Rules

Under the terms of the preventive suspension order, the respondents are placed under suspension without pay for a period not to exceed six months, pending the final termination of the administrative adjudication of their case.

Preventive suspension under the Office of the Ombudsman is a provisional measure and does not constitute a finding of guilt. However, it removes the suspended officials from their posts for the duration specified, effectively halting their exercise of official functions during the investigation period.

The Ombudsman has jurisdiction over public officials and employees in connection with acts done in the performance of their official duties, and is empowered under Republic Act 6770, or the Ombudsman Act of 1989, to impose preventive suspension as part of its investigative authority.

Catanduanes Government Faces Leadership Vacuum During Suspension

With both the vice governor and a large bloc of SP members placed under simultaneous suspension, the Catanduanes provincial government faces a significant reduction in its legislative quorum and executive leadership capacity at a time when the province continues to recover from the effects of Super Typhoon Uwan.

The typhoon, which struck in November 2025, left widespread destruction across Catanduanes — a province in the Bicol Region historically vulnerable to typhoons due to its geographic position in the Philippine Sea. The province has long been recognized as one of the most typhoon-exposed areas in the country.

The complaint filed by Governor Azanza and the subsequent Ombudsman action underscores the critical importance of proper and timely QRF utilization in disaster-affected provinces, particularly in the immediate aftermath of a major weather event when relief operations are most urgently needed.

As of the date of this report, Friday, May 29, 2026, no public statement has been issued by Vice Governor Fernandez or any of the suspended SP members in response to the Ombudsman's order. The administrative adjudication of the case remains ongoing.
